The special terms of sale are supplemented by the general terms of sale which follow the special terms, and by the conditions relating to data protection available on our website and via the following direct link:

1 – Reservation

Any reservation made more than 30 days before arrival must be accompanied by a deposit corresponding to 30% of the total price of your rental and any additional services reserved at the same time, no booking fees will be charged.

This payment must reach us within 5 working days after your reservation is made. After this period, your option will be canceled. Your reservation is considered final once it has been confirmed by us (sending a booking confirmation by email). Without confirmation from us, your reservation cannot be considered final.

The full price of your rental and any additional services is due one month before the start of your stay. In case of late booking, less than 30 days before arrival, the total amount of the stay will be required at the time of booking. If the balance is not paid 30 days before arrival, LES CIMES D’AUREA reserves the right to consider your reservation canceled and to apply the cancellation conditions provided for and defined below.

Bank charges for any check or transfer drawn or made on a foreign bank will be borne by the guest and added to the reservation amount. Payments by check will not be accepted less than one month before arrival.

2 – Prices

Our prices are inclusive of all taxes and include the provision of the accommodation, charges included (water, electricity, heating), except for the tourist tax, payable directly on site.

Optional services: our accommodation rates do not include additional optional services offered on our website and on site.

In case of an increase in VAT or the application of any new taxes on the price, LES CIMES D’AUREA reserves the right to apply this increase to the rates without prior notice and to apply the new rate on the effective date.

3 – Tourist Tax

The tourist tax, collected on behalf of the municipalities, is not included in our rates. Its amount varies depending on the municipalities. It is paid on site.

4 – Modification/Cancellation of stay and additional services by the client

In case of cancellation or modification, you must notify us by email at contact@lescimesdaurea.com, the date of receipt determining the date of modification or cancellation.

Any change of stay dates will be considered a cancellation and will be subject to the cancellation fees mentioned below.

If you notify us more than 30 days before the start of your stay, the amount of your reservation will be fully refunded. If the cancellation occurs between 30 and 15 days before your arrival, we will retain 30% of the total amount of your stay including additional services. If the cancellation occurs between 14 and 8 days before your arrival, we will retain 75% of the total amount of your stay including additional services. If the cancellation occurs between 7 days and the day of your arrival, we will retain 100% of the total amount of the stay including additional services. If you do not show up at the location of your stay, we will retain 100% of the total amount of the stay including additional services.

However, if you have subscribed to the insurance contract offered by LES CIMES D’AUREA, and if the conditions of said contract are met, you may benefit from the coverage of cancellation fees. We invite you to read the conditions of this insurance and remind you that subscription is optional.

Absence of right of withdrawal: We wish to remind you that under Article L 221-28-12 of the Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering, and leisure services provided on a specific date or period. Therefore, all reservations and orders made on our websites and with a sales advisor at the LES CIMES D’AUREA reservation center are not subject to the right of withdrawal.

In accordance with Article L211-14 II of the Tourism Code, you have the right to terminate the contract before the start of the trip or stay without paying termination fees if exceptional and unavoidable circumstances occurring at the destination or in the immediate vicinity have significant consequences on the execution of the contract or on the transport of passengers to the destination. In this case, you are entitled to a full refund of payments made, without additional compensation.

5 – Arrival and departure

Keys are handed over from 4 p.m. on the day of your arrival, and must be returned before 10 a.m. on the day of your departure.

6 – Security deposit

A security deposit of €800 will be required upon your arrival. It will be refunded at the end of your stay after payment of services consumed on site and after deduction of any indemnities for damages (following a contradictory inventory on your arrival and departure days).

7 – Pets

Your pet is welcome at the LES CIMES D’AUREA Residence. The supplement is €20 per day, and €100 per week-long stay due to the thorough cleaning required after their visit. Only one pet is allowed per accommodation.

We reserve the right to charge an “Animal Damage” fee in case of stains, odors, damage to furniture, etc. (non-exhaustive list) that would prevent the accommodation from being re-rented without thorough cleaning.

For hygiene reasons, pets are not allowed in the SPA area.

Pets must not be left free and must be kept on a leash in the common areas of the residence. They must not be left alone locked in an accommodation in the absence of their owner, who is civilly and legally responsible. First category dogs “attack dogs” (pit bulls…) and second category dogs “guard and defense dogs” are prohibited.

We strongly recommend that you inquire before your arrival for the acceptance of your pet.

8 – Internal Regulations

To facilitate your holiday life, internal regulations are available in each accommodation; we thank you for reading and respecting it. We specify that it is strictly forbidden to – Bring skis, ski boots, sledges, and any ski equipment into the apartments or onto the balconies – Hang laundry on balcony railings. In case of non-compliance with these rules, as well as in case of non-compliance with the internal regulations, we reserve the right to charge a flat rate of €150 minimum for damages caused. Forgotten personal belongings inside the apartment when vacating the premises do not engage the responsibility of LES CIMES D’AUREA.

9 – Interruption of Stay

An early departure or interruption of the stay will not entitle you to any refund from LES CIMES D’AUREA.

However, if you have subscribed to the insurance contract offered by LES CIMES D’AUREA (see article 15), you may, depending on the cause of the departure from the Residence or the interruption of the stay duly justified and in compliance with the conditions of the contract, benefit from a prorated refund, from the day of your departure from the Residence or the day of interruption of your stay. Regarding the interruption of the stay, you can only benefit from the prorated refund of the stay if you have completely vacated the apartment.

10 – Possible Modification of our Programs and Cancellation of the Stay by LES CIMES D’AUREA

If circumstances require it, due to events beyond our control, and/or in case of force majeure, we reserve the right to partially or totally modify our programs (total or partial closure of a site, a common facility such as a game room, beauty area…).

Conditions for possible modifications to programs: the services and activities announced, as part of upgrading the health conditions of the services, as part of construction delays, the services and activities announced, as part of on-site leisure, may be changed without notice depending on certain local imperatives (cultural events, sports events, political events, etc.) during which the services would no longer be available.

However, if before the date of the stay and in case of external events imposing themselves on it or exceptional and unavoidable circumstances, LES CIMES D’AUREA was compelled, exceptionally, to modify an essential element of the contract or to cancel your stay, it undertakes to inform you as soon as possible and to offer you, as far as possible, equivalent or superior replacement solutions. Failing agreement on your part on the proposed replacement solution, LES CIMES D’AUREA will fully refund the payments made, in accordance with articles L 211-13 and L 211-14 of the Tourism Code.

11 – After-Sales Service – Complaints

The guest has 48 hours after arrival to report in writing to the establishment’s reception any dispute concerning the description, quality, or cleanliness of their accommodation. After this period, LES CIMES D’AUREA will not consider any complaints regarding the aforementioned points. Any subsequent complaint relating to your stay must be submitted in writing to our Quality Department (by registered letter with acknowledgment of receipt accompanied by a copy of your dispute declaration to the reception for the cases provided) within a maximum period of 1 month after the end of your stay, so that we can respond to it as soon as possible. We also thank you for specifying your reservation number, the location and dates of your stay, as well as the type of apartment reserved in order to facilitate the processing of your file. In case of non-consumption of a prepaid service, attach a certificate issued by the site, justifying non-consumption. No refund will be granted during your stay. We remind you that forgetting personal belongings inside your apartment when vacating the premises does not engage the responsibility of LES CIMES D’AUREA.

12 – Dispute Resolution

In accordance with Ordinance No. 2015-1033 of August 20, 2015 and the implementing decree No. 2015-1382 of October 30, 2015, any dispute or consumer dispute, subject to Article L.211-3 of the Consumer Code (https://www.legifrance.gouv.fr/affichCodeArticle.do?idArticle=LEGIARTI000031076294&cidTexte=LEGITEXT000006069565), may be the subject of amicable resolution by mediation with CMAP – Paris Mediation and Arbitration Center. Disputes that are obviously unfounded or abusive, or have already been examined or are being examined by another mediator or by a court, or if the consumer has submitted their request to the mediator more than one year after their written complaint to LES CIMES D’AUREA, or if the dispute does not fall within the mediator’s jurisdiction, or if the consumer does not justify having attempted, beforehand, to resolve their dispute directly with LES CIMES D’AUREA through a written complaint according to the terms provided, where applicable, in the contract, cannot be reviewed by the mediator. To submit your dispute to the mediator, you can (i) fill out the form on the CMAP website: www.cmap.fr tab “you are: a consumer” (ii) send your request by regular or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or (iii) send an email to consommation@cmap.fr. Regardless of the method used to contact CMAP, your request must contain the following elements to be processed quickly: Your postal, email, and telephone contact details as well as the full name and address of the LES CIMES D’AUREA establishment, a brief statement of the facts, and proof of prior steps taken with LES CIMES D’AUREA.

13 – General and Specific Conditions

Booking one of our stays implies acceptance of our general and specific terms and conditions of sale. We provide a general description and photos of our apartments for informational purposes. Some apartments are equipped for people with reduced mobility. For more details, do not hesitate to ask our Residence. We also remind you that any request regarding a specific orientation or location of the apartment is considered a preference and does not constitute a contractual guarantee. All information concerning sports and leisure activities in mountain resorts, as well as their surroundings, is transmitted to us by the Tourist Offices and is provided to you for informational purposes. They do not engage our responsibility in case one of them no longer exists during your stay. For any additional information regarding life in these resorts, please contact their respective offices directly. Since our brochures are printed well in advance, please inquire with our Reservation Service about opening dates, sports facilities (nature and quantity), activities, or services offered on the site that influenced your choice.

14 – Liability

We would like to inform you that renting a tourist residence does not fall within the responsibility of hoteliers. Consequently, LES CIMES D’AUREA’s liability cannot be engaged in the event of loss, theft, or damage to personal effects in our residences, both in the apartments and in the parking lot or common areas (bike and ski room).

LES CIMES D’AUREA’s liability may be engaged in the event of failure to meet its obligations, within the limits set by law.

15 – Bloctel Device

In accordance with article L 223-2 of the Consumer Code, we inform you of your right to register on the telephone canvassing opposition list “Bloctel” (https://www.bloctel.gouv.fr/).
